1. Who we are and what this policy covers

This Privacy Policy explains how Dailylight LLC (“Dailylight”, “we”, “us” or “our”), a mobile app studio based in Massachusetts, USA, collects, uses and shares information when you visit dailylightllc.com (the “Website”) or use any mobile application we publish on the Apple App Store or Google Play (each an “App”; together with the Website, the “Services”).

Some Apps may have an app-specific privacy notice that adds detail to this policy. If an app-specific notice conflicts with this policy, the app-specific notice applies to that App.

2. The Website

The Website is a simple informational site. It:

  • does not use cookies, local storage or similar technologies;
  • does not use analytics, advertising, tracking pixels, social media widgets or third-party fonts or scripts;
  • does not contain forms that collect personal information.

Server logs. Like most websites, the Website is delivered by a hosting and content delivery network (CDN) provider. When your browser requests a page, that provider automatically processes standard technical data such as your IP address, the date and time of the request, the page requested, your browser’s user agent and the referring page. This data is used to deliver the Website, keep it secure and protect it against abuse, and it is handled under the provider’s own data practices. We do not use it to identify or profile visitors.

Email. If you email us, we receive your email address, the content of your message and anything you choose to attach. We use it to respond to you and to keep a record of our correspondence.

3. Our Apps

Each App is different, and the information an App collects depends on its features. The specific data each App collects is disclosed in its App Store privacy label (“App Privacy”) and its Google Play “Data safety” section, and in any app-specific privacy notice. In general, depending on the App, we may process the following categories of information:

  • Information you provide, such as content you create or enter in the App, preferences and settings, and, if the App offers accounts, your email address or sign-in identifier.
  • Purchase information, such as which in-app purchases or subscriptions are active. Payments are processed by Apple or Google. We do not receive or store your full payment card details.
  • Device and usage information, such as device model, operating system version, app version, language, approximate region derived from settings, and how features are used.
  • Diagnostics, such as crash reports and performance data, which help us find and fix problems.
  • Support communications, when you contact us for help.

Our Apps only request device permissions (for example, notifications, photos or camera) when needed for a feature, and you can change these permissions at any time in your device settings.

4. Third-party services and SDKs

Our Apps may include software development kits (SDKs) or services from third parties that help us operate them. Depending on the App, these may include:

  • Analytics, to understand in aggregate how features are used so we can improve them;
  • Crash reporting and performance monitoring, to detect and fix bugs;
  • In-app purchases and subscriptions, processed by Apple (App Store) or Google (Google Play), and possibly a subscription management service that helps us validate purchases;
  • Cloud hosting and storage, if an App syncs or backs up data.

These providers process information on our behalf or under their own privacy policies, as applicable. The SDKs used by a particular App, and the data they collect, are reflected in that App’s store privacy disclosures. If an App shows advertising or uses data for tracking across other companies’ apps or websites, it will say so in its store listing and, on iOS, ask your permission through Apple’s App Tracking Transparency prompt first.

5. How we use information

We use information to:

  • provide, maintain and improve the Services and their features;
  • process and restore purchases and manage subscriptions (through Apple or Google);
  • diagnose crashes, fix bugs and keep the Services secure;
  • respond to support requests and communicate with you about the Services;
  • prevent fraud and abuse, and enforce our Terms of Use;
  • comply with legal obligations.

We do not sell your personal information, and we do not share it for cross-context behavioral advertising, unless an App clearly discloses otherwise and, where required, asks for your consent.

6. How we share information

We share information only as described in this policy:

  • Service providers who help us run the Services (such as hosting, analytics, crash reporting and purchase validation), under obligations to protect it;
  • Apple and Google, as the distributors of our Apps and processors of payments, under their own terms and privacy policies;
  • Legal and safety: when we believe in good faith that disclosure is required by law or legal process, or is necessary to protect the rights, property or safety of Dailylight LLC, our users or others;
  • Business transfers: if Dailylight LLC is involved in a merger, acquisition, financing or sale of assets, information may be transferred as part of that transaction, subject to this policy;
  • With your consent or at your direction.

7. Children’s privacy

Our Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13, consistent with the U.S. Children’s Online Privacy Protection Act (COPPA). If you believe a child under 13 has provided us with personal information, please contact us at support@dailylightllc.com and we will delete it. Where local law sets a higher age of digital consent, we apply that age.

8. Data retention

We keep personal information only for as long as needed for the purposes described in this policy: for example, for as long as you use an App, or until you ask us to delete it. Support emails are generally kept for up to 3 years. Crash and analytics data is kept in line with our providers’ retention settings, typically no longer than 26 months. We may keep some information longer where required by law, to resolve disputes, or to prevent fraud and abuse. Data stored only on your device stays there until you delete it or uninstall the App.

9. Security

We use reasonable administrative, technical and physical safeguards to protect information, including encryption in transit (HTTPS/TLS) and access controls. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If we learn of a security breach affecting your personal information, we will notify you as required by applicable law, including Massachusetts law.

10. Your choices and rights

Wherever you live, you can ask us to:

  • access the personal information we hold about you, or receive a copy of it;
  • correct information that is inaccurate;
  • delete your personal information;
  • opt out of any marketing communications.

To make a request, email support@dailylightllc.com with the name of the App and the email address or account identifier you used (if any). You can also see our data deletion instructions. We may need to verify your identity before acting on a request, and we aim to respond within 30 days or sooner where the law requires. We will not discriminate against you for exercising your rights.

You can also control data on your device: change App permissions in your device settings, reset or limit your advertising identifier, and turn off notifications at any time.

11. U.S. state privacy rights, including Massachusetts

Residents of certain U.S. states, such as California, Colorado, Connecticut, Virginia and others with comprehensive privacy laws, may have additional rights, depending on whether those laws apply to us. These may include the right to know what personal information we collect, use and disclose; to access, correct and delete it; to obtain a portable copy; to opt out of the “sale” or “sharing” of personal information, targeted advertising or certain profiling; and to appeal our decision on a request.

We honor these requests where applicable. As stated above, we do not sell personal information or share it for cross-context behavioral advertising unless an App discloses otherwise. You may make a request yourself or through an authorized agent by emailing support@dailylightllc.com. If we decline your request, you may appeal by replying to our decision with the subject line “Appeal”.

Massachusetts residents. We protect personal information in line with Massachusetts data security and breach notification laws (including M.G.L. c. 93H and 201 CMR 17.00, where applicable), and we will notify affected residents and authorities of a security breach as those laws require.

12. International users

Dailylight LLC is based in the United States, and our Services are operated from the United States. Our service providers may process information in the United States and other countries. If you use the Services from outside the United States, your information may be transferred to, stored and processed in countries whose data protection laws may differ from those where you live. Where required, we rely on appropriate safeguards for such transfers. If you are in the European Economic Area, the United Kingdom or a similar jurisdiction, you may have rights under local law (such as the GDPR), including to object to or restrict processing, to withdraw consent, and to lodge a complaint with your local data protection authority. Contact us to exercise these rights.

13. Changes to this policy

We may update this Privacy Policy from time to time. When we do, we will update the “Last updated” date at the top of this page. If changes are material, we will provide additional notice, such as through an App or on this Website. Your continued use of the Services after a change takes effect means you accept the updated policy.
